Absolute Liability

Absolute liability, which is also commonly referred to as strict liability, occurs when a person is responsible for injuries or damages that occur, without regard to fault or negligence. This legal concept operates primarily in the area of products liability law, in that a seller is absolutely or strictly liable for any product defects or characteristics that result in a threat to a consumer's safety. For example, a seller is strictly liable for selling a product that is unreasonably dangerous or defective in some way. Therefore, a seller is absolutely or strictly liable for any injuries resulting from a product, regardless of whether the product was created with a lack of due care or in a negligent manner. Even if the seller took all precautions to market a safe product, the seller can still be liable for any resulting injuries from that product under the concept of absolute liability.
