Fatalities Accidents

Fatalities from accidents caused by the negligence of a person or entity often result in lawsuits, typically in the form of wrongful death claims. All states have wrongful death laws that permit immediate relatives and/or the personal representative of the deceased person's estate to bring a claim against the party responsible for the death, seeking compensation for the loss of the deceased person. Any proceeds from the claim belong to the deceased person's estate, and so will benefit the deceased person's heirs, which typically consist of immediate family members. Among the available damages sought in a wrongful death lawsuit are quantifiable expenses such as medical bills and funeral costs, as well as damages that are more difficult to quantify, such as lost wages, lost support for dependents, and pain and suffering. The nature and extent of available damages depends primarily on the law of the state in which the suit is filed.
