The number of fatal car accidents each year still claims an unacceptable number of people's lives, despite precautions taken in recent years such as the installation of air bags in new vehicles, seat belt and child restraint laws in all states, and increasingly harsh penalties for drunken driving. As a result, fatal car accidents that result from a driver's speeding, drunken driving, or other traffic violations can result in both criminal and civil liability for the driver under state law. The extent and nature of the potential liability, in both the civil and criminal arenas, depends on the situation, as well as the available remedies under state law. On the criminal side, a driver who commits a serious traffic violation that results in death, and particularly one that involves alcohol or drugs, is likely to face fairly severe penalties, including driver's license suspension, community service hours, probation, fines, and even incarceration. On the civil side, while incarceration is not a possibility, a hefty financial judgment is very possible, again, depending on the circumstances involved in the case.
