Restitution is a remedy in equity whose goal is to restore the plaintiff to his or her original position prior to the loss or injury. For instance, if a person loses his or her vehicle in an automobile accident due to property damage inflicted by another party, then that person may be entitled to restitution for his property loss, i.e. compensation for the value of the lost vehicle. In personal injury actions, restitution is used as a measure of damages, in that it provides a monetary remedy for a plaintiff's losses and/or injuries. Restitution, therefore, is one of the most easily computed and relatively uncontroversial aspect of a personal injury case; as a result, it is likely that restitution is ordered as a remedy in most successful personal injury claims.
