Suing for wrongful death is not always as straightforward a proposition as one might assume. Wrongful death statutes vary from one state to another, and what might constitute a valid wrongful death claim in one state might not qualify in another state. For example, there are only certain people who are eligible to bring a wrongful death claim under a particular state's laws. While most state wrongful death statutes require that the personal representative of the decedent's estate bring the wrongful death claim, other states freely permit surviving immediate family members to do so. Still other states permit other, more distant relatives to bring a wrongful death claim, such as parents or even grandparents of the decedent.
