Wrongful Death Injury

When a wrongful death from an injury due to the negligence of another person occurs, that person is potentially liable, not in a traditional personal injury lawsuit, but in a wrongful death lawsuit. A wrongful death claim can result from many different circumstances, including accidental poisoning, fatal prescription drug interactions, medical malpractice, fires, plane crashes, automobile accidents, use of defective products, slip and fall incidents, accidental drownings, and accidental shootings. Even if the person does not immediately die from his or her injuries, but dies at a later date from those same injuries, wrongful death claim is an option in most states. Typically, a wrongful death claim is filed by the personal representative of the decedent's estate, and/or his or her immediate family members. A person who acted negligently in causing another person's death, then, can face substantial financial responsibility if found to be responsible for the death through wrongful death legal proceedings.
