Wrongful Death Negligence

In a case of wrongful death, negligence is the most common level of intent found in unintentional accidents. Although there are some cases of reckless, malicious, or even intentional acts that lead to the wrongful death of another person, many of these cases involve only a level of negligence on the part of the responsible party, or a true accident. Despite the fact that a person was merely negligent in his or her actions, which, theoretically, could have just as easily led to a non-fatal accident as a fatal accident (or even no accident at all), the liability is the same under a wrongful death action. In all cases where even negligence has led to another's death, the responsible party is liable for compensatory damages pursuant to that state's wrongful death laws. Compensation for wrongful death varies based on state law, but can include damages for funeral expenses, medical bills, pain and suffering, loss of future wages or income, and other losses to surviving family members.
