Nevada Jury Awards $20.5 Million To Woman For Cancer Misdiagnosis Which Resulted In Husband's Wrongful Death
Las Vegas, Nevada -- In 2000, the medical negligence of a Nevada hospital directly led to the eventual death of man at the hands of cancer. In 2007, his widow was finally vindicated knowing that those she believed to be responsible for her husband's death were finally found liable in a court of law. The jury found the Emergency Physicians Medical Group liable for the man's death and awarded his widow Jackie Templeton 20.5 million dollars in damages.
It was claimed by Mrs. Templeton that the Emergency Physicians Medical Group failed to detect a large, abnormal mass that was clearly visible on the patient's x-ray. As such, the group of physicians failed to notify Mr. Templeton of his condition which led to his not being able to receive the proper treatment in a timely manner, and ultimately led to his death in 2000.
The court was shown several images of the x-rays showing the malignant mass which eventually developed into full blown cancer and later claimed Mr. Templeton's life. The jury, upon viewing the images, found that a trained medical physician should have seen the mass and informed the patient of the finding. Had the physicians not been negligent in this manner, the jury believed that they could have held follow up sessions for the patient which would have invariably led to treatment, in turn, possibly saving his life.
