The loss of a beloved family member is even more tragic when the death occurred suddenly and wrongfully. Surviving family members are left with the unthinkable in a situation of pain and suffering. Unfortunately, with the sadness and grievance, other issues and questions arise that need to be dealt with immediately.

With so many trucking accidents occurring every year in the United States, the circumstances and factors leading to these fatal driving accidents can be widely varied. Make no mistake; the results, regardless of the cause, are deadly any way one looks at these incidents.

Trucking accidents occur for many reasons.  Some of the most prevalent reasons include:

  • driver fatigue (working long work shifts)
  • driver intoxication (drugs and/or alcohol)
  • rushing to meet deadlines
  • blind spots
  • driver stress
  • overloading of the truck

Trucks are the most dangerous vehicles on the road today.  Though new laws and regulations have been passed to avoid a fatal truck accident from occurring, these fatal motor vehicle accidents still kill about 5,000 people in the United States per year.  If someone you know was killed in one of these catastrophic accidents, you may be eligible for compensation.  Contact a wrongful death attorney immediately.

Statute of Limitations

Wrongful death lawsuits are subject to the statute of limitations, which define the time frame in which the surviving family members can initiate a lawsuit. Generally, the wrongful death statute of limitations law allows between 1 and 3 years to put forth a claim.

As always, there are exceptions. For instance, if the death was originally attributed to an accident rather than someone’s negligence, courts will adjust the statute of limitations to take effect from the time the true cause of death was discovered.

If one of your loved ones has died in a fatal truck accident, contact a lawyer immediately. A specialized wrongful death attorney can provide invaluable information as it relates to many specific details you might not be aware of and which will then ultimately weaken your case.
