During a lawsuit where monetary damages are awarded, the plaintiff will not receive one lump sum as a settlement at the end of the lawsuit. More, specific areas will be analyzed and assessed in order to identify how much money would be a reasonable compensation for the plaintiff.

Damages that were caused by the injury are so-called special damages. Special damages are not limited to, but may include:

  • Ambulance charges
  • Medical bills
  • Hospital bills
  • Wage loss
  • Property repair
  • Replacement cost
General damages are very subjective and presumed to be a result of the defendant’s actions. General damages are not limited to, but may include:
  • Pain and suffering
  • Future problems
  • Crippling effects
  • Inability to perform a task
  • Hurt to reputation
  • Loss of anticipated business
  • Other harm

Punitive damages on the other hand are intended to punish and set an example for the public. Punitive damages are awarded if the defendant acted in a malicious or reckless way that the plaintiff is left with general as well as specific damages. Companies on the other hand might also be awarded punitive damages if reckless behavior caused damages to several consumers.
