There are many families where one person is the sole or main provider for every family member. In case that person suddenly dies, the family must now reevaluate their situation and calculate loss wages. The expenses of daily life can be draining on working families, but the added expense of a funeral may take too much out of families and their loved ones. The pain and grief over losing a loved one is enough of a stressor for families and their loved ones, but anxiety over wages for living should not be a concern.

In wrongful death cases, survivors of the deceased have the option of suing the defendant for loss of wages in a loss wages claim. The issue of how this monetary compensation, as well as possible punitive damages, will be settled is a complicated and lengthy process. Ruling courts will consider several factors and make a decision based on:

  • The person’s employment status
  • The person’s age
  • The person’s residual employment skills

Additional factors that experts analyze and assess include:

  • Economic loss
  • Work expenses
  • Analysis of loss of household production capacity
  • Analysis of personal consumption and maintenance
  • Life care costs/medical needs
  • Hedonic damages
  • Analysis of job-related fringe benefits
